 The law on the sale of alcohol & our company's policy

It is a strict company policy not to sale any alcohol to under-18s in the UK. It is a criminal offence to sell alcohol to a person who is under the age of 18 years in the UK. About the terms and conditions
Please read these terms of sale carefully before placing your order and retain a copy of these terms and your order for future reference. These terms and conditions apply to all wines, spirits or other goods or services supplied by Anteros Wine and Spirits Merchant Limited (“Anteros Wine and Spirits” or “we”) to you ("the Customer", “you” or "your"). Anteros Wine and Spirits is a trading name of Anteros Wine and Spirits Merchant Limited (company number 12824024, VAT Number: 356632387) whose registered office address is at 94A, Fulham Road, South Kensington, London SW3 6HS.
Note: 
Wholesale Customer Account: An account that is set up and have been approved by our company after successfully passing the due diligence test in accordance with the Alcohol Wholesaler Registeration Scheme (AWRS). 
1. Content
1.1 We reserve the right to vary our prices, product descriptions and website (www.anteroswineandspirits.com) content whenever necessary.
1.2 The prices displayed on our wholesale product pages are exclusive of VAT and do not include delivery. A detailed VAT invoice will be issued by email once your order has been placed.
2. Order & Order Cancellation 
2.1 As a usual term, we have a minimum order for 4 cases, each case contains 6 bottles. We generally will not accept orders less than four cases of wines, unless and otherwise with the agreement between Anteros Wine and Spirits Merchant Limited and you (the Customer). However, we may set out a minimum order amount and may reject orders that do not meet the minimum.
2.2 Within the minimum order you may choose or “mix and match” a maximum of four different types of products. When we accept an order it is subject to the availability of the products for delivery. To order from us as a wholesaler, you must register a wholesale customer account with us. The registration of the account is free of charge.
2.3 Once we have accepted and processed your wholesale customer account, you may submit a Purchase Order either through an agreed system, or via our “Order form” via email. For verbal orders e.g. via telephone or in person in urgent cases to stock our products, we will note your intended order and send an email to confirm your order. Once we have received your confirmation via email on your verbal order, we will issue your with an invoice with the intended delivery date and the amount, and payment due date. 
2.4   If it is known or came to the realisation or knowledge that the customer is under the age of 18 in the United Kingdom this can be an out-right refusal to sell the alcohol and will provide a refund. Where there is a reasonable explanation, we will require the customer to present additional proof of age documentation/ identification.
2.5 Failure to present proof of age document / identification upon request we operate a “no proof, no sale, age verification policy” which means your order will be refused and cancelled. This will be made clear until we are satisfied the customer is over the age of 18 in the United Kingdom. The age limit may be different in other jurisdiction and this must be adhered in the jurisdiction where the customer resides or are resident of. 
2.6 You may cancel your order at any time until seven working days after the day the goods are delivered. Cancellations should be made in writing or by email at info@anteroswineandspirits.com Where goods have already been delivered there may be a charge to cover the collection. Wines must be returned unopened and in their original condition. It is your responsibility to keep the wines safe until collection is made. Please refer our terms and condition on "Returns" under clause 11. 
3. Availability
3.1 If we have accepted your order, but do not have the products requested in your order, and then we may substitute suitable alternative products which we may consider are of no lesser quality, or to inform you in writing of the products that is not available.
4. Wholesale Customer Account Opening
4.1 Anteros Wine and Spirits Merchant Limited is a government approved wholesaler of alcohol under the Alcohol Wholesaler Registration Scheme (AWRS). Our unique reference number is: XQAW 000 0011 5023
4.2 In order to comply with the AWRS, we have a due diligence policy. The policy is available on our website by clicking HERE, alternatively it should be attached as a Pdf. attachment with the accompanying email we have sent to you. If you would like a copy, please contact us via info@anteroswineandspirits.com Under our the due diligence we are require to conduct a risk assessment on our customer in order to comply with HMRC’s guidance to tackle illicit alcohol to be sold in the open market and any fraudulent goods. We will ask for some of the information as set out in our due diligence policy. To apply, please click HERE
4.3 Once you've passed the due diligence check under the AWRS, you will be assigned a Wholesale Customer Account. An account number will be assigned to you. If you have not or did not receive an account number from you, please email info@anteroswineandspirits.com  within 30 days of opening your account being confirmed as being opened. 
5. Payments
5.1 Full payment of goods must be made at the point of sale by retail customers. As a retail customer, payments must be made online via our online store at the time of confirming your order through using our online payment options, which includes card payment options. Payments made online must be made in full and without set-off.  
5.2 As for our Wholesale Customer Account holder, payment must be made upon receiving the the invoice issued by the Company by the date as specified on the invoice. For telegraphic transfer usually it will take 2 days for confirmation and for cheque 7 days to process.
5.2 We will not receive cash payment for any orders over £500. For cash payments, there will be enhanced due diligence checks on the company before it is accepted, and a receipt will be issued following the receipt of the cash payment. Cash payments can only be made in person. Upon receiving cash payment, a receipt will be issued by Anteros Wine and Spirits Merchant Limited. 
5.3 All of your payments must be made in full and without set-off or deduction. If you dispute an invoice, it must still be paid in full but credit will be given against future invoices if resolution of the dispute means that we should make a refund. 
6. Late payment
6.1 If payment is not received by the requested due date, we may charge interest on the overdue amount at the yearly rate of 4% above the base lending rate of the Bank of England. This interest shall accrue on a daily basis from the due date until the date of actual payment (in cleared funds) of the overdue amount, whether before or after judgment.
6.2 If demanded the Customer must pay us interest together with other debt collection charges incurred and the overdue amount. We can charge you with costs of recovering the outstanding sun, or future orders or terminate this contact, or any contract made under it.
7. Payment & Age Verification Checks
7.1 To ensure that your credit, debit or charge card is not being used without your consent, we will validate name, address and other personal information supplied by you during the order process against appropriate third party databases.
7.2 By accepting these terms and conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information. You can rest assured that this is done only to confirm your identity, that a credit check is performed and that your credit rating will be unaffected.
7.3 If there is doubt that the customer's age is below 18 years of age in the United Kingdom, we have a legal duty to determine a person’s age by requesting and checking proof-of-age documentation. If it appears, they may be under 18 or appearance under age of 25, they must be challenged and provide photographic evidence they are at least 18 before any sale of alcohol takes place.
7.4 Policy on checking the proof-of-age documentation: Anteros Wine and Spirits Merchant Limited’s policy are those who are selling alcohol online or by mail order must be trained to check documents are valid and acceptable. Individuals who are checking the proof-of-age documentation must take the document and examine it carefully on both sides before checking:  
o Date of birth indicates the person is 18 or over;
o Photograph is a true likeness of the person requesting alcohol;
o Hologram is present and genuine it has not been forged, altered or tampered with; and
o It is valid, current and has not expired.
o If there are any bouts, or there is a reason to suspect the document is forged or borrowed, the sale or service of alcohol must be refused.
o To ensure that the ID documentation is not borrowed, ask them their name, date or birth and star sign and if there is any hesitation the ID maybe borrowed
7.5 Acceptable proof-of-age documents: Anteros Wine and Spirits Merchant Limited’s policy outlines the following documents can only be used as an acceptable proof of a person’s age, in the case of online sales a copy of the ID document could be scanned to verify the age and bank details to ensure they are the same person:
o A valid passport;
o A valid UK driving or provisional driving licence with photo and date of birth;
o A valid European Union photo card, driving licence; or
o A valid photographic identity card bearing the national Proof of Age Standard Scheme (PASS) hologram.
7.6  Where necessary we may need to refuse the sale if we are not satisfied the person is over the age of 18.
8. Data Protection & Privacy Policy
8.1 All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.All information revealed through due diligence checks shall be used by us in accordance with our privacy policy that can be found on the Terms and Conditions page at www.anteroswineandspirits.com  
8.2 Although we may refer any information which appears to be fraudulent or unlawful to relevant third parties such as police, intelligence agencies, or other law enforcement authorities as may be appropriate to comply with the law of England and Wales, and any laws within the devolved administration of the United Kingdom.
9. Delivery time & Recommended Retail Price (RRPs)
9.1 Upon accepting your payment, an invoice will be issued and the intended delivery date will be on the invoice. We aim to deliver your order within 21 days of the invoice but it can be earlier. If there is high demand for our products or we cannot meet the intended delivery date, we will inform you in writing. We will do our utmost to comply with the delivery date; however, there might be external factors which may cause delays which we will review on a continuous basis.
9.2 Upon accepting your payment, an invoice will be issued and the intended delivery date will be on the invoice. We aim to deliver your order within 21 days of the invoice but it can be earlier. If there is high demand for our products or we cannot meet the intended delivery date, we will inform you in writing. 9.3 The Recommended Retail Price (RRPs) produced for our wholesalers is only an indication and recommended only. How external businesses/ companies or organisations set their price is within their control and authority to do so. Whether they increase or decrease the price to sell directly to their retail customers is in their right to do so in line with the competition laws of England and Wales, Scotland and Northern Ireland. This includes Malaysia and Singapore. However, retailers must comply with the respective laws on the minimum alcohol pricing, for example, in Scotland and other similar jurisdiction that sets a minimum alcohol pricing.  
9.4 The instructions will be given to UPS courier company as part of the process on the adult signature required service where a signature and proof of age must be acknowledged to our staff, together with an online signature from the recipient. Anteros Wine and Spirits Merchant Limited have been noted by UPS as a business account holder that we are shipping wines (alcohol). Our company have also signed the International Special Commodities (ISC) programme and agreement for the transportation of alcohol as applicable (https://www.ups.com/gb/en/help-center/packaging-and-supplies/special-care-shipments/wine.page)    
9.5 UPS courier service with “adult signature required” service upon delivery (https://www.ups.com/gb/en/shipping/services/value-added/delivery-confirmation.page) to be selected before shipping to the customer. 
9.6 The “adult signature required” service have been used as part of Anteros Wine and Spirits Merchant Limited wholesale of alcohol that we are currently operating as an online/ mail order retailer and as Government approved alcohol wholesaler under the Alcohol Wholesaler Registration Scheme (AWRS). 
9.7 The “Adult Signature Required” service UPS will obtain the adult recipient’s signature and provide Anteros Wine and Spirits Merchant Limited (the sender) with a printed copy. We will also be able to view the adult recipient’s signature online. What is meant by an adult signature and is acknowledged to our staff is that adult recipients must have reached the legal age of adulthood in the receiving country (over 18 years old) in the United Kingdom.  
10. Liability
10.1 Risk of damage to or loss of the goods passes to you at the time of delivery to you. Unless specified on the products page, goods do not come with any warranty or guarantee other than implied by law for business to business sales. 
11. Returns
11.1 We do not accept returns of unwanted or non-faulty items. You will inspect the products on delivery and any which are damaged, do not conform with the order (other than substitute products), are short (other than where this is not the final instalment delivery) or are excess may be rejected, and any shortages or damages must be reported and be made in writing directly to the Company within 3 working days via email info@anteroswineandspirits.com quoting invoice number, receipt, reasons and photographic evidence.
11.2 No returns are acceptable without Anteros Wine and Spirits Merchant Limited’s prior approval, and delivery instructions for transport. Shipping will be charged. All claims shall be waived and automatically be cancelled if they fall outside this timescale. 
11.3 All returns are at the customer’s expense. Returns must be made within 28 days of original delivery and goods must be in a resalable condition. We reserve the right to only accept back up to 25% of the original order.
12. Termination
12.1 We may terminate this contract if you commit a material breach which, if remediable, is not remedied within 14 days of receiving notice of default.
12.2 We may also terminate this contract if it appears to us that you (or any person who has guaranteed your obligations to us) are unable to pay your debts as they fall due (including by reason of becoming subject to any insolvency event such as commencement of any winding up or administration proceedings). Termination shall not prejudice any other rights we may have against you. Upon termination, all outstanding debts will become immediately payable and our obligations to you will cease.
12.3 We may also terminate this contact if we are made aware, have found, or later realise that you (individual/ adult(s)/ organisation(s) / agency) have purchased or attempted purchase of alcohol by or for an under-18-year-old in the United Kingdom [UK]. It is also an offence for an under-18 to buy or attempt to buy alcohol. We therefore reserve the right to cancel any order and/or delivery of any alcohol purchased by someone under-18 or for someone under the age of 18 years in the UK. Please refer to our company's policy on the sale of alcohol to under 18 year-old & Challenge 25 policy. 
13. Ownership and risk
13.1 Transfer of risk passes from us to you once you have accepted delivery of the order. Ownership of the goods shall not pass to you until we have received in full cleared funds of all sums due in respect of the order. We shall be entitled to recover payment for the goods even though ownership of any of the goods has not yet passed from us.
14. Retention of title
14.1 Notwithstanding delivery and the passing of risk, property in and title to, the goods shall remain with the seller until the seller has received payment of the full price of (a) all Goods and/or Services the subject of the Contract and (b) all other goods and/or services supplied by the seller to the buyer under any contract whatsoever.
14.2 Payment of the full price shall include, without limitation, the amount of any interest or other sum payable under the terms of this and all other contracts between the seller and the buyer.
15. Force majeure
15.1 We are not liable for any delay or failure to perform any of our obligations if the delay or failure results from events or circumstances outside our reasonable control, including but not limited to acts of God, accidents, acts of terrorism, war, fire, strikes, lock outs, failure of any communications including telecommunications or computer systems, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and we shall be entitled to a reasonable extension of its obligations.
16. Applicable Law
16.1 These terms and conditions will be subject to the laws of England and Wales. We will try to solve any disagreements quickly and efficiently.
16.2 If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so in the English courts. Nothing in these terms and conditions limits or excludes your statutory rights as a consumer. 
17. Policy on the sale of alcohol, Challenge 25 & Operating Schedule.

What information we collect?

5.1 You can email info@anteroswineandspirits.com or contact your contact within our company to request that your data be deleted. However, please note, by deleting your personal data you may impact the service we can provide to you. We will not delete data which is needed to fulfil a contract until that contract is completed, or unless we agree to terminate the contract. We will inform you if deleting your data will impact our ability to perform a contract in case this affects your decision.
6. How long does Anteros Wine and Spirits Merchant Limited keep my information? 
6.1 We retain personal data for as long as necessary to provide services and products to you, to fulfil the transactions you have requested, or for other essential purposes (for example, complying with our legal obligations, resolving disputes and fulfilling our agreements). We will store your personal data for a minimum of six years after your last transaction with us, unless we have a legitimate or contractual reason or a legal obligation to retain it thereafter, for example you might hold stock in our cellars.

Google Analytics collects the IP address assigned to you on the date you visit sites, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Google’s ability to use and share information collected by Google Analytics about your visits to this Site is restricted by the Google Analytics Terms of Use and the Google Privacy Policy.
7. Information Storage
7.1 We are committed to protecting the security of your personal data. We store data in a number of places depending on our requirements to access and use it. We use a variety of security technologies and procedures to help protect your personal data from unauthorised access, use or disclosure. For example, we store the personal data you provide on cloud based or computer systems that have limited access and are in controlled facilities. When there is a need to transmit data over the internet, it is protected by encryption and or passwords. Where possible, we avoid storing paper records of personal data.
8. Personal data 
8.1 When you contact us to make an enquiry, we will use your name and contact information to respond. We will then use this information to communicate with you during the provision of our services to you. We collect and update information about users of our services. We may obtain this information via direct contact with you, from third parties such as other users who refer you to us or automatically via your use of our services.
8.2 This information may include your contact details, registration and payment details, support problems, details around participation in events, prize draws or surveys and certain relevant details of your product preferences and contact permissions.
8.3 For each visitor to our website, our web server automatically recognises the user’s domain name. We also collect the email addresses of those who communicate with us via email and anonymously aggregate information on which pages users access or visit. Information volunteered by users, such as survey information and/or site registrations, is also collected. We will only use information collected in a survey on an anonymous basis unless we have your permission to do otherwise.
8.4 If you are a registered user of our services, we will gather further relevant information, such as generic types of data accessed, time of access, volume of use of services and traffic data from use of our website. Traffic data includes logs, details of networks, data and systems accessed, details of the sender and recipients of messages sent over our services, times and location of log on or access, duration of sessions, clickstream and similar usage or system data. Traffic data may sometimes be traceable to and or related to not just companies but named individuals. Before you register with Berry Bros. & Rudd for access to services or transactional areas of our website, you can browse our website anonymously and we will not collect your data.
8.5 We may also receive your personal data when processing gift requests from customers where you are the recipient. We process that data initially under contract with the gift purchaser and any secondary processing such as product updates and associated events will be because we have a legitimate business interest to do so.
8.6 We may collect and use your information to administer, support, improve and obtain feedback on our services and to detect and prevent faults, breaches of our network security, the law or our contract terms. If you are registered to use a service, we may use the information you provide to us to carry out the service; we may also contact you to obtain feedback on that service and any improvements we could make to it.
9. Information Sharing 
9.1 We work with third parties in the provision of some of our services, for example research agencies to help us improve our customer service, or marketing service providers who help us contact our customers and logistics partners who help deliver products. 
9.2 On request, and when relevant to a service you use, we can provide details of which third parties we work with. We will also discuss and agree on any specific security questions or requirements you may have during the provision of our services.
9.3 The third parties we work with – including those who provide email and storage solutions used in our day to day work – are monitored on how they meet the requirements of current UK data protection legislation and the requirements of GDPR. When we contract with third parties we enter into agreements that encourage GDPR compliance. 
9.4 We do not share nor sell your personal data to anyone else.
9.5 Exemptions to the above are where we are asked to provide information as a result of a court order or to recover monies due. Other exemptions include requests from law enforcement and intelligence agencies of the United Kingdom for all lawful purposes.

11. Transfer of data outside the EEA 
11.1 Please note that some data recipients may be located outside the EEA. In such cases we will transfer your data only to such countries as approved by the European Commission as providing adequate level of data protection, or enter into legal agreements ensuring an adequate level of data protection.
12. Marketing
12.1 We may use your Personal Information, such as your name, email address, telephone number, etc. ourselves or by using our third party subcontractors for the purpose of providing you with promotional materials, concerning our services, which we believe may interest you.  
12.2 Out of respect to your right to privacy we provide you within such marketing materials with means to decline receiving further marketing offers from us. If you unsubscribe we will remove your email address or telephone number from our marketing distribution lists.

The law on the sale of alcohol & Our Company's Policy

At Anteros Wine and Spirits Merchant Limited it is our priority to promote the Licensing Objectives as set out under the Licensing Act 2003. We operate a strict policy not to sell alcohol to under-aged customers in their respective policy. It is a strict company policy not to sale any alcohol to under-18s in the UK. It is a criminal offence to sell alcohol to a person who is under the age of 18 years in the UK. It is also an offence for an under-18 to buy or attempt to buy alcohol. 
Training 
Guidance will be given to staff in relation to prevention of underage sales as part of the staff training. The staff will understand the process to ensure that online verification of the date of birth and address of the customer to ensure that they are over the age of 18. There will be two verification processes, once before the potential customer enters to our online site, and secondly a declaration at the time or before the payment is made that the person purchasing the alcohol is over the age of 18:
· If it is known or came to the realisation or knowledge that the customer is under the age of 18 online staff is trained  to refuse a sale. This can be an out-right refusal to sell the alcohol and provide a refund.
· Where there is a reasonable explanation, we will require and request the customer to present additional proof of age documentation/ identification.
· Failure to present proof of age document / identification upon request we operate a “no proof, no sale, age verification policy”. This will be made clear until we are satisfied the customer is over the age of 18.
· Challenge 25 & age verification policy: This is the most important policy and part of the prevention of underage sales. Our policy remains unchanged below:
· Everyone selling alcohol has a legal duty to determine a person’s age by requesting and checking proof-of-age documentation. For online sales/ mail order ,the website have two verification process 1) declaration the person entering the website is over the age of 18, and 2) at the point of sale or before payment, the customer must declare they are over the age of 18, and have read our terms & conditions. Where necessary we may need to refuse the sale if we are not satisfied the person is over the age of 18.
· If it appears they may be under 18 or appearance under age of 25, they must be challenged and provide photographic evidence they are at least 18 before any sale of alcohol takes place.
· The purpose of Challenge 25 policy helps the business to reduce the risk of underage sales by removing the need for staff to accurately assess whether or not someone is under 18 years old, giving certainty.
· Once the verification is done to check the online purchase is made by an 18-year-old, the shipment will be logged with UPS courier service with “adult signature required” service upon delivery (https://www.ups.com/gb/en/shipping/services/value-added/delivery-confirmation.page) to be selected.
· The “adult signature required” service have been used by Anteros Wine and Spirits Merchant Limited and will continue to do so.
· The “Adult Signature Required” service UPS will obtain the adult recipient’s signature and provide us (the sender) with a printed copy. I (the sender) will also be able to view the adult recipient’s signature online. What is meant by an adult signature and is acknowledged to our staff is that adult recipients must have reached the legal age of adulthood in the receiving country (over 18 years old) in the United Kingdom.
· Policy on checking the proof-of-age documentation: Anteros Wine and Spirits Merchant Limited’s policy are those who are selling alcohol online or by mail order must be trained to check documents are valid and acceptable. Individuals who are checking the proof-of-age documentation must take the document and examine it carefully on both sides before checking:  
 
o Date of birth indicates the person is 18 or over;
o Photograph is a true likeness of the person requesting alcohol;
o Hologram is present and genuine it has not been forged, altered or tampered with; and
o It is valid, current and has not expired.
o If there are any bouts, or there is a reason to suspect the document is forged or borrowed, the sale or service of alcohol must be refused.
o To ensure that the ID documentation is not borrowed, ask them their name, date or birth and star sign and if there is any hesitation the ID maybe borrowed.
Acceptable proof-of-age documents: Anteros Wine and Spirits Merchant Limited’s policy outlines the following documents can only be used as an acceptable proof of a person’s age, in the case of online sales a copy of the ID document could be scanned to verify the age and bank details to ensure they are the same person:
o A valid passport;
o A valid UK driving or provisional driving licence with photo and date of birth;
o A valid European Union photo card, driving licence; or
o A valid photographic identity card bearing the national Proof of Age Standard Scheme (PASS) hologram.
